Key briefing points about this article:

  • There is no disputing that human lawyers are well-beyond AI-based legal reasoning today
  • Developers are striving mightily to get AI toward achieving on par lawyering to attorneys
  • Some contend that human lawyers will never be exceeded by such AI systems
  • To ponder this question, we can consider the overall notion of AI versus human intelligence
  • The presumably subsumed question about lawyers is somewhat shaped accordingly

Introduction

Running a marathon has certainly become a national pastime.

The runners at the front are usually quite versed in running. One form of excitement, though also potentially a disappointment, involves a frontrunner that scoots past everyone else and largely distances themselves from the rest of the pack. They are the frontrunner that steadfastly and unyieldingly remains the frontrunner throughout the entire race.

By definition, we can likely agree that the frontrunner presumably is indeed always at the front. Of course, the frontrunner can change hats, in the sense that a runner from behind edges and goes past the existent frontrunner. What I’m trying to indicate is that it is conceivable that at some point in time a particular frontrunner might not be at the front. They could potentially lag behind and be exceeded by some other newly anointed frontrunner. Imagine that there was once a frontrunner of person A, and subsequently, the frontrunner is person B.

I trust there is no undue dispute about such a possibility.

Under what conditions might a frontrunner always be at the front and never relinquish the vaunted title of being the frontrunner?

In the case of AI in the law, some pundits insist the venerated human lawyer will always be the frontrunner. Any form of AI-based legal reasoning…
